First, (happy dance) I called it! I called it! :) :)
Second,

Why wouldn't the phylactery go with Redcloak when he used Word of Recall?

Is there something specific about WoR that bans certain items coming with you? Didn't see it here: http://www.d20srd.org/srd/spells/wordOfRecall.htm

Is a reasonable GM judgement call to say "it technically has a soul bound to it, so I'm technically treating it as a second person, so Xykon's inherent unwillingness, level, saves, etc. come into play"?

Is this a case of "plot overpowers rules"?

I'm fine with any, but it seemed odd. If you don't treat the phylactery as anything more than just another magic item, you'd think it would go with Redcloak just like Redcloak doesn't leave behind other items or clothing. Same reason why anything on your person goes with you in any similar spells; people don't teleport naked, generally.

EDIT: Never mind, I'm not fully caffienated this morning. Just saw that O-Chul removed it.

He was not in possession of it at the time, you have to be touching it.

He wasn't "wearing" the phylactery at the time of the Recall seems like a logic answer to me.
