Alright so I do some game trading on a couple sites. It usually goes good but this last trade went bad. This guy lives in Temple City and I was hoping someone lived near there and didn't mind knocking on someones door asking about a trade with crispydave?

Bad as in you've sent in your stuff but haven't received anything back?

Did you keep all (and I mean all) of the correspondence between the two of you? If you did, then just go straight to the Temple City PD if he won't hold up his end of the trade. If you've been cheated by this trader then they've just committed mail fraud.

I do some trading on Bartertown on occasion, and we take that stuff pretty seriously. Keep trying to find out why they haven't held up their end of the bargain, of course, but if it persists then just sic the police on him.

I have all messages between us saved.

I have sent my end of the deal and it has been a month since then. It has been about a week since I last even heard from him.

Well then, I say if they don't come up with a really good reason pretty soon, then get in contact with the Temple City PD.

that's what I was looking into. I just don't like dragging authorities into things sometimes.

It's probably the best idea. The guys at Bartertown could tell you stories, especially some of the old guard (hell, there's one fraudster that has his own warning thread). This happens more often then you'd probably think.

well I finally got a message form the guy saying he will ship tomorrow. If I don't get it in a week I will be calling the police.

I told him 1 week. If he wants to risk not paying for speedy shipping it's his own damn fault I've waited long enough.

But then he could just say "it's been shipped. I had a lot of things going on and just didn't get around to it." That's a pretty valid excuse, whether true or not.

Have him send you a tracking number when he ships it. It may take longer than you'd like to get across the US, but if it's on the move at least you'll get it.

That's still not a crime. Best you could do is probably civil suit for failure to uphold a contract. INAL, but IIRC, you can't get someone arrested for scamming (fraud) unless the value of the money/item is over a certain amount, $5,000 unless I'm misreading the US Code (http://www.law.cornell.edu/uscode/18/1030.html).

I don't know what your prototype is, but if you're trading it for a Zen, it can't be worth that much (note: I have a Zen and love it, but it's still only about $120).

Like I said, best bet is to tell him to send a tracking number for when he ships it. If he doesn't at the end of your week, contact the police (www.lasd.org) and tell them you'd like to report fraud, giving the name and address of the individual. Likely, you won't get much of a response, but it makes a record for if other people have the problem with the guy.
