You would think playing DND for nearly 10 years I should know the rules by now.
What's the rule on a caster using a scroll that is higher level then what he can cant normally. A 3rd level caster can cast 2nd level spells but I want to use 3rd and 4th level scrolls, whats the check for this?

Caster Level Check, DC is actually CL of scroll + 1.
If the user meets all the requirements noted above, and her caster level is at least equal to the spell’s caster level, she can automatically activate the spell without a check. If she meets all three requirements but her own caster level is lower than the scroll spell’s caster level, then she has to make a caster level check (DC = scroll’s caster level + 1) to cast the spell successfully. If she fails, she must make a DC 5 Wisdom check to avoid a mishap (see Scroll Mishaps, below). A natural roll of 1 always fails, whatever the modifiers.

This means it is pitifully easy to cast scrolls two or three spell levels higher than your current maximum.
And in fact, at level 1, you have a 20% chance of casting a 9th level spell from a scroll.
(And at level 4, the first time you can actually afford a 9th level scroll, you have a 35% chance. And remember, if you fail to cast, nothing bad happens to the scroll if you succeed a DC 5 Wisdom check.)
