I'm wondering what magic items can/can't be used by a frenzied berserker during a rage and frenzy.

Barbarian Rage (SRD):
"While raging, a barbarian cannot use any Charisma-, Dexterity-, or Intelligence-based skills (except for Balance, Escape Artist, Intimidate, and Ride), the Concentration skill, or any abilities that require patience or concentration, nor can he cast spells or activate magic items that require a command word, a spell trigger (such as a wand), or spell completion (such as a scroll) to function."

Okay, so here it says that you can't activate items that have a command word. Looks like you can still activate magic items that are classified as "swift (mental)," which is a bunch.

Frenzied Berserker Frenzy (CW):
"While frenzied, the character cannot use any Charisma-, Dexterity-, or Intelligence-based skills (except for Intimidate), the Concentration skill, or any abilities that require patience or concentration, nor can she cast spells, drink potions, activate magic items, or read scrolls. She can use any feat she has except Combat Expertise, item creation feats, or metamagic feats."

Pretty enveloping term here. It seems all activated items are out... Or are they?

Cloak of Predatory Vigor (MIC):
"A cloak of predatory vigor helps you channel the power of your combat frenzy into rejuvenating energy. While in a rage or frenzy, you can activate this cloak to heal damage to yourself equal to your Hit Dice."

It's activation is listed as "swift (mental)." Is this an EXCEPTION to the frenzy restriction, or are "swift (mental)" activated items still cool with frenzy?

Sounds like CoPV is the exception to the rule.
