There's a spell in complete mage of the same name, and it doesn't actually detail what the spell does, besides saying it makes a Genius Loci.

It's not really one of these, is it?

Read what the spell does. I am 105% sure that a non-epic spell does not summon a CR 30 monster to fight for you.

Yep. Your very own epic monster!
Nah, it summons an elder elemental.

Nope. It says in the spells text that it takes the form of an elder elemental, of a type of your choosing.

No, you read what the spell does.

/facepalm

I kept reading that line, and kept missing the "elder" part. Just saw elemental, and I thought, that's pretty vague. The Genius Loci is an ooze, now that I check its type.

what about gate?

In the case of a single creature, you can control it if its HD do not exceed twice your caster level.

A level 17 caster can use its 9th level slot to cast gate and summon and control an outsider with 34HD. By level 20 it is 40HD and still not epic.

And CR can be horribly under or over valued on occasion.

Although, the genious loci has 70HD so it is immune to gate and any non epic spells that I know of. I am just arguing the overall point.
