Simply put, does Penetrating Strike make an Assassin's Death Attack work against the undead? :smallconfused: I'm not finding anything in the books that would specifically say it doesn't work.

Since Death Attack only requires that the target be Sneak Attack-able, it should work. However, note that undead and constructs are immune to attacks that require Fortitude saves unless they also work on objects, which would make them immune to Death Attack.

Anyways, from the way I would understand it, it wouldn't work for death attack. I think it would ultimately be up to your DM though.

Nope. Go read the Undead type (http://www.d20srd.org/srd/typessubtypes.htm). "Immunity to any effect that requires a Fortitude save." Death Attack requires a Fortitude Save. Thus Undead are immune.
