Under the Binder entry in Tome of Magic it says that the summoned vestige speaks in whatever language was used to call it.

Under the Words of Creation (BoED) any non-good creature suffers damage when speaking the words.

Can you speak in the Words of Creation when summoning the vestige and thus force the vestige to speak using the words of creation.
Would it then be viable to summon say the vestige of Orcus (Tenebrous) used and make him speak in the words of creation, thus causing his real self damage?

Dismiss Vestige without making a pact, rinse and repeat ad inifitum until every last fragment of Tenebrous ceases to exist.

This could be swapped about with Dark Speech and summoning good aligned vestiges, though that is a lot harder to argue.

Vestiges don't really exist anymore, so they'd be pretty hard to damage. The manifestation is really just an illusion. I'm pretty sure the Words of Creation/Dark Speech penalties apply only to creatures.

The Vestige may well speak that language but it doesnt actually have to say anything, Im not too up to up on Binding so can a vestige refuse to answer?

The vestiges are entities seperate from any other form that used the same name. They also do not have stats other than the boons they provide to those who bind them and as such there is no RAW way of killing or destroying the vestiges either, or through them the entities that share their name.

Also, technically, Vestiges don't have alignments, not being entities in any sense of the word.

For thoroughness, even if you did manage to do something to 'harm' Tenebrous (though in all honesty, it's hard to fathom how that would be possible, or even what form that 'harm' would take), it wouldn't affect Orcus any. They've been split up, and if anything Orcus very much wants Tenebrous to stay a Vestige, because if Tenebrous does come back, that does Orcus no good. Orcus needs a way to become a new Tenebrous, not bring the old one back.
