So besides the Pirates of the Caribbean soundtracks, which I've already thought of what other music would make a good background for a swashbuckling D&D game?
preferably no stuff with lyrics as that makes it harder to DM?

The soundtrack to Pirates of the Burning Sea has always worked pretty well for me.

Depending on how serious you want it, Monkey (http://www.youtube.com/watch?v=WgFctTLlH-Q) Island (http://www.youtube.com/watch?v=JbWZjfLO2Z0&feature=related) music (http://www.youtube.com/watch?v=VK0b9bHMyfk&feature=related). Also, this (http://www.youtube.com/watch?v=jxXWcYRzwAY) from Baldur's Gate II might fit.
Or something (http://www.youtube.com/watch?v=hXvFfmB00j8&feature=related) from Sid Meier's Pirates perhaps?

:D

But more seriously...

Empire Total War Naval Battle I (http://www.youtube.com/watch?v=XmttJbRgrws)
Empire Total War Naval Battle II (http://www.youtube.com/watch?v=lih7Z5py5HY&feature=related)
(and so on?)

Now that that's taken care of. (http://www.youtube.com/watch?v=os5TXyJlEMc)

Honestly, this (http://www.youtube.com/watch?v=mFM1CF9bqho) or any of the suggested songs on the same page fit the theme pretty well in my opinion, and are instrumental to boot. They are mostly a bit more on the serious side, so you may need to look elsewhere for some more upbeat sounds.

Also I imagine any instrumental version of a classical sea shanty would go over quite well.

The Soundtrack of the movie 1492: Conquest of Paradise (http://www.youtube.com/watch?v=KhLteof982M&feature=related) has some nice tracks.

I ran a pirate campaign once. We, uh, never stopped singing that. Ever.

Heroes of Might and Magic 4 has fairly fitting music: 1 (http://www.youtube.com/watch?v=hkDXNSWJLuo), 2 (http://www.youtube.com/watch?v=YuQyvzYWdQE&feature=related).

Obligaroty link (http://www.youtube.com/watch?v=SBdC5YT6Vvg&feature=related).

Oddly enough, this (http://www.youtube.com/watch?v=j26GMgxU7tA&feature=related) looks like a good soundtrack for sea travel.

Loreena McKennitt writes very interesting music: 1 (http://www.youtube.com/watch?v=JvPu2PGzcSg&feature=related), 2 (http://www.youtube.com/watch?v=m54SmVsQqgc&feature=related), 3 (http://www.youtube.com/watch?v=flKfIBCy6Ik&feature=related).

Perhaps I'm odd, but I've always thought Jupiter (from the planets, Holst) sounded kind of swashbuckly

It occured to me, that Fairy (http://www.youtube.com/watch?v=izU2ClzSTys&feature=related) Tail (http://www.youtube.com/watch?v=Ai4MAwo_vPU) might invoke the right mood.

Many songs on the One Piece soundtrack are perfect.

' Pirates of Penzanance ' by Gilbert and Sullivan (for the light hearted moments obviously)

in the end I used Pirates of the caribbean, Pirates of the burning sea, conquest of paradise, master and commander, and empire total war, I think the choice of music suitbly inspired the players so thanks for the sugestions. I shall note down the other sugestions for later games!

Everything Named Dark Waters was made for a NWN2 campaign.
Best thing it's under a CC-license.

Check out the Pogues. Not all of their music is quite "high seas", but there (http://www.youtube.com/watch?v=lM5x3TJpP24) are (http://www.youtube.com/watch?v=SWXpZK5vSWY) a few (http://www.youtube.com/watch?v=tuCBfZWYTHQ) gems (http://www.youtube.com/watch?v=lyUwykasKhY) if you (http://www.youtube.com/watch?v=23DO6TbvdXA) look (http://www.youtube.com/watch?v=b6fFJX4OkDw).

(If you want to startle your players, just play Squid out of Water, the second link. Anyone not familiar with the song will be quite surprised at 3:16.)

The game Anno 1503 (that is 1503 AD for Americans) has a quite fitting soundtrack (some are actually instrumental versions of modern pop titles, but they still fit the theme quite well).
If you don't mind lyrics in another language (I find this a lot less distracting, but YMMV), there are some German titles you could use (or try to find an instrumental version of):

Die Ärzte - Kaperfahrt (this one is actually used in Anno 1503)
In Extremo - Segel Setzen
Rammstein - Die Flut
Subway To Sally - Knochenschiff
Subway To Sally - Seemannslied
