I think that maybe a Battle mystery Oracle would be better suited to what you want to do

And regarding your question, yes and no. The maximum spell level is set by a table, every odd character level you learn a new level of spells.
However you need certain amount of wisdom to cast them (11 for 1st level spells, 12 for 2nd level spells, etc) and wisdom you gain through items may let you cast spells you would normally not be able to.

Never underestimate Improved Unarmed Strike.
or be more cheesy and use spiked gauntlets.

The advantage of these, is that you can always be considered armed, even without your big sword in hand, which entitles you to AoO on unsuspecting enemies (and DM's). I have seen battle clerics use one of these quite effectively, and Improved Unarmed Strike gives you a good, non-lethal damage option when you're full of steroids bull's strength and other buffs.
