Divine caster is wearing a periapt of wisdom +10 which gives them 2 additional 9th level spell slots they wouldn't normally have. They cast two 9th level spells, then fail their will save to keep the periapt from getting disjoined. When losing the extra spell slots because of their new, lower wisdom score, can they elect to lose the two slots they've already used, or do they have to lose unused slots?

Putting aside how you got the Periapt +10 in the first place (oh epic...), Clerics prepare their spells, including any bonus spells, at a set time of day. Any spells you've already prepared can't be lost with loss of Wisdom. You still must have the requisite Wisdom score to cast the spell you want (in this case 19).

So if you had 28 Wisdom, cast two level 9 spells, and lost 10 Wisdom for some reason, you'd still have your other level 9 spells prepared, but you wouldn't be able to cast them. Then if you cast Owl's Wisdom on yourself later, you'd be able to cast the level 9 spells for the duration.

I disagree with the previous answer to this question. If you no longer have the wisdom to grant the bonus spell slot, you lose the slot.

If the loss (or removal) of the device results in the loss of 2 9th level spell slots you should determine randomly which slots have disappeared. This means, in the example given, you would have a 50% chance of losing each of the 9th level spells you still have prepared (roll separately).Cleric entry in the SRD (http://www.d20srd.org/srd/classes/cleric.htm):
To prepare or cast a spell, a cleric must have a Wisdom score equal to at least 10 + the spell level. [...]

Like other spellcasters, a cleric can cast only a certain number of spells of each spell level per day. His base daily spell allotment is given on Table: The Cleric. In addition, he receives bonus spells per day if he has a high Wisdom score. A cleric also gets one domain spell of each spell level he can cast, starting at 1st level. When a cleric prepares a spell in a domain spell slot, it must come from one of his two domains (see Deities, Domains, and Domain Spells, below).

Clerics meditate or pray for their spells. Each cleric must choose a time at which he must spend 1 hour each day in quiet contemplation or supplication to regain his daily allotment of spells. Time spent resting has no effect on whether a cleric can prepare spells. A cleric may prepare and cast any spell on the cleric spell list, provided that he can cast spells of that level, but he must choose which spells to prepare during his daily meditation.Emphasis mine. The cleric chooses some time (dawn, say) to gain his spells. If he has a high wisdom score at the time of preparation, he receives bonus spells. If he loses wisdom later, it potentially affects his ability to cast the prepared spells, but he already prepared them.

I'm currently AFB, but IIRC Ray of Stupidity (Spell Compendium) explicitly states that wizards may be unable to cast their high level spells due to the int damage, implying that they still have the slots but lack the ability to use them.

Lastly, even one interprets the above text to imply that the spells go away, RAW is silent on the issue of which slots go away - perhaps because they don't. Any ruling without textual support is a house rule; these need to be labeled as such, especially in a thread that's all about the RAW.

Ultimately, the RAW is silent on this issue, to my knowledge. I'd lean toward the former interpretation though, simply because it's less paperwork.

It is low priority on the RAW checklist, as it is not a primary source, but the 3.5 FAQ on page 61 explicitly refers to this:


Q:Do ability enhancing items (such as the headband of
intellect, cloak of charisma, and periapt of wisdom) grant
bonus spells to the appropriate spellcasters?

A: blah <snip>

If you lose the item, you immediately lose the bonus spell
slots the item gave you, starting with any uncast spells you
have of the appropriate levels.
