level and ability breakdown
11 levels of warblade (skills not assigned)
Has a homebrewed template "Heir to the triumvirate" as part of a campaign
Heir grants DR 8/- and Immunity to mind affecting, as well as the ability to learn Ex or Su abilities in place of feats. This is where he gets Quickness.
Quickness functions as the choker ability of the same name, allowing him one additional move or standard action each turn
his level 3,6,9 feats and 2 warblade feats are not chosen yet.

Uses Hearing the Air stance (blindsense) if invisible foes, otherwise uses Shifting Defense stance (move 5ft when missed).
Often prepares Dazing strike, Divine surge, Iron heart surge, Revitalizing strike one more
Make full use of quickness ability to ruin a foe's day.
I cheated a little bit by giving him an extra 4th level manuever.

So I ask: Is he really a CR 8-9? What other feats should I give him? What are a few "get out of jail free" magic items I can give him so he can be a recurring villian? Are there better Maneuvers than what I gave him? Should I give him better equipment?

Any given maneuver is either readied or it's not, you cannot have the same maneuver readied more than once.

This list (http://www.giantitp.com/forums/showthread.php?t=187851), and maybe a single-use item of this power (http://www.d20srd.org/srd/psionic/powers/fieryDiscorporation.htm) for the recurring part. A +1 Animated shield, his AC looks a bit low for a CR 9 villain.

Boost his Will save, you don't want a simple Time Hop (http://www.d20srd.org/srd/psionic/powers/timeHop.htm) to disarm him. Iron Will (2,000 gp via the Otyugh Hole instead of costing a feat), Detatched and/or Plucky (http://www.d20srd.org/srd/variant/buildingCharacters/characterTraits.htm), Mage Slayer, etc. can help.

He's using a quarterstaff, so it should deal two-handed damage if he's not taking two weapon fighting penalties to wield it as a double weapon.

I'd say it looks about right for a CR 9 otherwise.

Thanks.

Also, should this be in homebrew instead of 3.5 forum?

You're in the right place.

With only a quick glance I'd say that's probably cr11, but a cr of party level +2 is good for a sub-boss.

Your AC is too low though. That's a melee type you've built there, he should be at least 3-4 points of ac above average for his CR and you've got him at 2 pts below average for a cr11.

Average ac for a given level is CR +13. Melee should be higher, casters can get away with lower, but skillful types and virtually all monsters should be right there.

I see PEACH from time to time. What does it mean? is it an acronym?

What is his level breakdown? Why does he have 11 HD? Why does he have Immune to mind affecting, DR 8, Quickness and quickness, what is his DR overcome by, and what does quickness do? Also +3 studded leather would give +6 AC.
