Flat footed means you haven't acted yet in combat. Nerveskitter can be cast before the roll for initiative, even when flat footed. After casting Nerveskitter, you have acted. So does this mean you can never be flat footed? It seems kind of cheesy.

Flat-Footed

At the start of a battle, before you have had a chance to act (specifically, before your first regular turn in the initiative order), you are flat-footed.
The clarification seals the deal - flat-footed you are and flat-footed you remain until you get a turn in the initiative order.

If it happens before the initiative roll, then by definition it is out of combat. Since you are casting it before combat begins, it has no effect on your flat-footedness, just like the Mage Armor you cast five minutes ago doesn't count.

Likely, the clarification was inserted because a similar situation already exists in Core: making an attack of opportunity (when one is provoked) with the Combat Reflexes feat.

Nerveskitter doesn't get rid of flat-footedness any more than such an attack of opportunity does.
