What exactly do you think happens when a Barbarian takes the feats Blazing Berserka (Sandstorm 49) and Frozen Berserker (Frostburn 48)?

The ice is on fire and the Barbarian is immune to fire and cold damage (immunity trumps weaknesses, see also 0*1.5).

See also Frostburn's version of Mantle of the Icy Spirit (spc's has a duration) and Sandstorm's Mantle of the Fiery Spirit.

How often are you going to be in a campaign which uses Frostburn but nobody has Spell Compendium? You're required to use the updated spell if your campaign makes use of the newer book.

Bonus bonus point if he also use that obscure bersek PrC from dieties and demi-god which allow him to become part-eagle.

No you are not. There isn't some special force of secret police that comes around to make sure you use only the most up-to-date material. You don't have to use everything in a book - if the group wants to ignore the newer version of the spell, its free to do so.

Oh they're out there, they are just too busy trying to get people to update to 4e, and now trying to get them into 5e, to really go after a minor spell update violation.
