PHB states that a failed check of 5 or more sends you under water. But whats the requisite to get 'above water' again? Is it presumed you can do it on your next move action or is there a swim check to get 'above water'?

As part of moving on a successful check, I'd assume.

Basically. When you fail by 5 or more, you sink 5 feet. So, logically, to rise 5 feet and get your head above water, you need to swim up! Which would be a move action, although you could potentially swim farther (up to 15 feet for a human) if you make your check.

would you need to pass a check to swim that 5ft upward?

Yes.

Success means you may swim at up to one-half your speed (as a full-round action) or at one-quarter your speed (as a move action). If you fail by 4 or less, you make no progress through the water. If you fail by 5 or more, you go underwater.

You have to succeed in order to swim any distance, even if that distance is underwater.
