Brief Introduction

My Little Pony: Friendship Is Magic is a reboot of the MLP franchise by Powerpuff Girls artist Lauren Faust, currently viewed by (almost) the entire Internet, not only the intended audience. Here is a place where we discuss the joy of friendship.

It's a clever show. It has excellent writing, character dynamics, humor, animation, and generally treats kids seriously rather than condescending to them. It has every right to be a 20 minute corporate committee designed infomercial, but it's not.

Pixar technically makes shows for little boys, and produce some of the best animation in the world.

No Brony could ask for more. I recommend watching the episodes in order. They're all up on Youtube. Unusually, Hasbro seems fine with having the entire series up in public because they've made no move to bring down any of the episodes. Search for "Friendship is Magic Episode 1" and you should find the series pretty easily... Or search for "Sharing is Magic" Google Doc. That is all.

Whoa, calm down there. The show is light hearted, optimistic fun but it's not for everyone. It's good fun, the community is good fun, and everyone can do with a reminder that friendship is magic but if it doesn't gel for you we'll love and tolerate you anyway. Plus, you might hit the wrong episode. Ask first?

> Derpy Hooves/Doctor Whoof

Two minor background characters who were adopted as emblems of 4chan. Derpy Hooves is so named due to an animation error in the first episode that had her eyes facing in different directions; 4chan has assigned her the role of Ponyville's mailpony, and her only line so far has been "Muffins". The show's animators are aware of Derpy's popularity and she's shown up a few times recently with her eyes obviously derped. Currently made canon in Feeling Pinkie Keen and in Faust's picture showcased below, Derpy was deemed important enough to appear in storyboards for Season II.

Dr. Whoof is a pony with an hourglass cutie mark; he and his kin save time and space very quietly off camera.

Deadly's Ironically Presented Anti-Spoiler Measures

DO YOU HATE SPOILER TAGS?

Well, Deadly's here to help you get rid of them... with a vengeance! Create a new bookmark in your browser and copy the code below as the link/url of said bookmark. Name it something helpful, like "Spoilers B GONE!" or whatever. Then whenever you view a thread here on GitP you just hit the bookmark and BAM! no more spoilers.

You won't even see the boxes, just the bare innards in all their gory glory.

It also makes sure that no image is wider than 600px, to avoid stretching pages, and will attempt to "intelligently" remove repeated images except avatars. Neat, huh? Sadly that last part means stuff like pony emotes may get lost but the forum doesn't make it easy for me to single out images in quotes as I'd have liked... that's an open problem, I guess.

Tested in Firefox, Chrome and Opera. Should work in any modern browser, but you never know with these things.

I honestly can't imagine why it happened now as opposed to any other time, particularly given the publicity. And, at this point, I'm not interested in speculating. I hope they reach someone at Hasbro with whom they could negotiate because just ending the project due to a stupid letter seems like a wasted opportunity for both Hasbro and Mane 6.

As someone who spends a great deal of his time making games, I can't even imagine what the dev team is feeling right now. To put that much blood, sweat, and tears into a game, only to have the plug pulled when the end was almost in sight?

I hope they can get this resolved.

I don't say this lightly, but if they can't do anything else, I think they should ignore it.

Statutory damages on one violation of copyright law max at $150,000 and, given what the documentary raised, I'm pretty sure a Fighting is Magic Kickstarter would break that amount. And once it's released into the wild, it can never be destroyed.

Just saw a message about it pop up as I was playing Skyrim. Scary part was that my follower at the time (Rarity) started crying "WHY?! WHY?! WHY?!" soon after O.o`

Research I suppose? Making sure they understood what it was they're wanting to cease and that it was ongoing before saying something. A lot of times big projects like this don't last and cease on their own accord.

Welp, I just found out about it. I need to read more about ponies. Even though I don't like most fighting games, that's really lame. Oddly enough, an associate of mine once sent me a link to obtain the infamous leaked copy, and I refused to get it at that time because I knew they didn't want it out and was kind of hoping to try the finished thing just once for bucks and giggles.

That said, I don't think Kickstarter would approve a funding project for the explicit purpose of tanking through a cease and desist order. Though I would believe the ramifications that could result from a success would be entertaining.

They could alternately finish it, leak it and instantly dissolve the corporation, blaming 'hackers' for the breach before fading into the walls. Since it's free software then there's no revenue stream to trace and no corporation to sue.

The Streets of Rage remake project had run for, what, 5 years? Maybe more. It was hit with a cease and decist the moment it was finished. They had informed Sega of the project right at the start, remade every single art asset from scratch for essentially the entire series and combined them into a single game that put every Streets of Rage release since the megadrive to shame. Then they were taken down. Nothing to be done.

There is no reprieve, there is no way out. There shaln't be a deal with Hasbro and unlike streets of rage remix, we will never even see the finished product.

And the worst part of it all is that there isn't even anyone to blame. It's just how things are.

And the fun little thing about American copyright and such laws is that if a company knowingly takes an action that decreases shareholder value, or knowingly doesn't take an action that would protect shareholder value, they are liable to be sued.

Even if the Hasbro execs and all the workers there are chill with Fighting is Magic, they legally must take action to avoid being sued.

It's just how the law is.

You could literally have a case like Hasbro now suing for damages while being sued by their shareholders for being too slow to do so.

Further point. I try to be very careful when I fling around random legal analysis even though we're not providing anyone with professional advice here. There is some misinformation in this thread and we should all stop talking about Hasbro's legal requirements because
a) They're not entirely clear and
b) We don't know enough to figure them out

My final thought is that they should stop thinking about the law. There's considerable money and goodwill to be had here if both sides actually got together and negotiated. The law can be made to conform to that if they agree with each other instead of being in opposition.

That line of thinking is why Steam smashed Gamestop and Apple annihilated Microsoft. Innovation in your business model can't be put into the 'never' category (20 years in business is the same as saying 'never' because 90% of your current staff probably won't be working there 20 years from now.)

Not something to rush into either, but inaction is fuel for creative destruction.

My final thought is that they should stop thinking about the law. There's considerable money and goodwill to be had here if both sides actually got together and negotiated. The law can be made to conform to that if they agree with each other instead of being in opposition.

Sell them the licence. Sell them the license and have them put it up on Kickstarter and send all of the money to Hasbro. These guys are doing this for free, if you don't capitalise on their hard work you are throwing both financial and reputation capital away.

If any business needs an Internet Relations division, it's Hasbro.

Too unique I'm sure. And I don't know how serious Faust is, but with needing to redo characters, move sets (because they are unique to each character), and backgrounds, there's no point in suggesting changing characters, they might as well start from scratch. I wonder though. What about the other games. Really, the only one I care about is Pony Chronicles, (http://ponychronicles.tumblr.com/), but if they're gonna kill any games related to them, then oh well.

Are video game copyrights different from TV shows? Or, does it matter here? Reason I ask is because abridged series suffer no (serious) repercussions from what they do. It's the same effect basically.Abridged Series are parodies. It's a heck of a lot easier to argue fair use when it's a parody. There also seems to be more apathy from the companies about it.

Using the copyrighted material as fair use without making money should be able to be done by anyone.Fair use does not work that way. There's more to it than whether it's profit or not.

Side note! I'm suddenly thinking about the actual level of technology in Equestria. While obviously magic is used for a bunch of things, at the same time I'm blanking on what they actually use for communication. There's some teleportation in letters and such, but I'm trying to figure out if they ever showed anything like phones.

Maybe by our standards, but for its time, the real-life Pony Express (http://en.wikipedia.org/wiki/Pony_Express) was pretty darn fast. I would not be surprised at all if that's what they would decide to call the show's mail service if necessary.

When I finally snap and burn the planet to the ground (conquest as a goal gets less and less likely every single day, as humans prove to me a little more every day that there is no point in preserving the species), I will be making a point of haulling up all the people make big decisions (political, legal, ecomonic or otherwise) and making a special point of dealing with their souls. And I do mean ALL. Not just the ones who would have been alive at the time.

I am not a fan of fighting games at the best of times, but to have two year's of work wasted (Hasbro don't escape any blame, they should have done this two years ago if they are required to have done it) is ridiculous.

To be fair, the system worked fine right up until the internet was invented. Then the first decade was spent as the province of a minute handful of nerds, the second was spent on oppression and lawsuits, and only now are we entering the days of mainstream internet power were the sheer inapplicability of the old laws creates an ongoing crapstorm of horrible situations.

The fact that a fix is not currently in the works is a dismal failure, but public pressure is building against some ancient and entrenched vested interests. It's a sad fact that the only way for a system to change is generational revolution - or, waiting for the Wrong Old People to die off - but I kind of like that way more than the proposed alternative of 'murder everyone, reap their souls'.

I think the most remarkable thing I learned from that process is that Hasbro doesn't have a department that goes around taking things offline. Instead you've got what is basically a call centre full of dudes who watch videos all day, every day, and these are just average schmoes without much legal understanding. They flag stuff and it automatically enters Youtube's system. Lawyers and cackling corporations are not actually involved at any point.

It's not malice, it's incomprehensible, apathetic bureaucracy.

EDIT: I would like to add that the Mentally Advanced guys are basically their own worst enemies in their fight by dint of the fact that they're trying to get paid for what they do.

It's reasonable to try and get paid for what you do, sure, but trying to make money from someone else's copyright (even if you're covered by fair use) is like swimming with an open wound. It draws the sharks.

If I was the fighting is magic team, I'd be snapping Faust up on her offer immediately. If I was thanqol I'd be popping in to offer them use of mask, because you never know.

Agreed. It almost makes me think that you shouldn't go into detail about your work so they won't send a cease and desist until it's too late.

First, it's kinda hard to gather team to do such a project if you do it in secret, second, you can't build recognition for what you're doing, third, you can still be hit with C&D once you publish it, and getting to that stage means the reaction might be even more drastic.

what i would really like to know is why they waited THIS LONG to send such a thing. everyone in the community has known about it for ages.

I honestly can't imagine why it happened now as opposed to any other time, particularly given the publicity. And, at this point, I'm not interested in speculating. I hope they reach someone at Hasbro with whom they could negotiate because just ending the project due to a stupid letter seems like a wasted opportunity for both Hasbro and Mane 6.

You know, it's kinda weird to hear you say Apple has ironclad case patenting rectangles and photoshopping competing products in court, then be sad when company that really stands something to lose has to send C&D letter, or risk being sued / losing their flagship product.

To me, first is still a travesty of patenting product, the second merely a sad consequence of dead end US legal system created. It's pretty much the same cause as why some companies that don't want to put DRM into their games - because US legal system forces them to or stand trial, so they err on the side of caution.

Oh well, I think I will play unfinished copy of Fighting is Magic today in memoriam :smallfrown:

I don't say this lightly, but if they can't do anything else, I think they should ignore it.

Statutory damages on one violation of copyright law max at $150,000 and, given what the documentary raised, I'm pretty sure a Fighting is Magic Kickstarter would break that amount. And once it's released into the wild, it can never be destroyed.

That assumes Kickstarter won't instantly shut down the whole thing once Hasbro sends them C&D letter, too. Plus, even is they won't, at this point it will be selling infringed product and Hasbro can demand, say, twice the project's profit (that is, twice the sum they raised) in court as punitive damage, IIRC.

They could alternately finish it, leak it and instantly dissolve the corporation, blaming 'hackers' for the breach before fading into the walls. Since it's free software then there's no revenue stream to trace and no corporation to sue.

Funny thing is, ever heard of guy who wrote RSS and Reddit? He tried to open scientific database that was nominally free to everyone. He did not publish the materials he pried from it, the database owner agreed to drop the case...

And it would be that, if US software protection laws that were lobbied to the point of being harsher than anti-drugs laws kick-started criminal case against him, with pretty much certain 35 years in prison and a $1 million fine hanging over his head. He didn't even leaked the data, no revenue stream, no corporation to trace. To be fair, the system worked fine right up until the internet was invented. Are video game copyrights different from TV shows? Or, does it matter here? Reason I ask is because abridged series suffer no (serious) repercussions from what they do. It's the same effect basically. Using the copyrighted material as fair use without making money should be able to be done by anyone.

Abridged series use parody/review fair use clause and even they tend to be shut down from time to time. But, the most important difference is, no one considers them a new product potentially threatening your trademark.

On a random question; The songs can't be taken off youtube because they are original (kinda) and use fanart instead of clips from the show. Correct?

If the fanart features characters Hasbro owns, yes, they can easily take them down on moments notice, it's just no one bothers. See their C&D letters to plushy makers they considered problematic, same thing.

Then what's the difference between a person making a drawing, or an animation, or direct music (taking a song directly from the show and remixing it or whatever), and someone making a video game (free) off that same IP?

None, it's just the first category is too small to be noticed, FiM was a big project that could potentially bring a lot of negative publicity if exploited by third parties, by both damaging the brand or being much more convincing case Hasbro doesn't protect its trademarks than a single picture/song, is my understanding.

Too unique I'm sure. And I don't know how serious Faust is, but with needing to redo characters, move sets (because they are unique to each character), and backgrounds, there's no point in suggesting changing characters, they might as well start from scratch.

And, eh, I spent a lot time looking on Faust concept art, and it wasn't all that hot, really. Even MLP designs are IMHO good because Faust original design was heavily edited, I know I would be much more reluctant to give series a chance if original proposal was retained.

Look, here's the thing that happened with Fighting is Magic. Yes, yes, I know "But they worked two years on it and why did Hasbro close them now THOSE MEANNIESS WAAHHH", well, here's the reasons why it happened now:

a) Mane6 started treating themselves as a company rather than a group of fans: A *lot* of fangames fall into this trap. When the group making it starts taking themselves seriously, treating themselves like a company releasing a product even a not-for-profit product, then other companies start taking YOU seriously as well. As a competitor. And they WILL blow you the hell up if they feel you're stealing their IP.

b) Evolution Championship Series 2013: We all remember this, right? How FiM almost got voted in, even though that it wasn't finished? How they made a whole competition of beating Fighting is Magic in charitable donations? How every other game was a for profit game? Yeah. Corps take a blind eye to things because, contrary to public belief, most of them don't like to litigate. It costs money. It costs time. It can blow up in your face. It's bad publicity. But when you're suddenly thrust out into the spotlight like Fighting is Magic was because of EVO? You, as a company, have to take action.

c) Start of the Fiscal Year: What was the other big news for yesterday? Yeah. Hasbro presenting it's newest expansions in the toyline for this year. Yeah, exactly.

d) Fan Project Collapses: Generally companies, about this sort of thing, simply wait for the project to collapse, rather than doing anything about it. Most fan projects above 'fan art' and 'fan fiction' or a simple Flash game do collapse in seconds after they're formed. Again, most corporations these days don't want to litigate. It's a waste of time and money, and it traumatizes public relations.

So, uh...no one should be surprised that this happened.

I suspect that the reason Fighting is Magic was taken down now rather than a year or two ago might be to do with people petitioning to get the game into EVO, which is a big fighting game tournament. It was posted on EqD, so naturally loads of bronies stepped up to make it happen (I believe it was to do with charity donations, which is good).

Of course, a lot of people weren't too happy about this, either because they weren't bronies, or were just hoping for another game to make the cut. It's possible one of them contacted Hasbro.

Yeah, you're right, I always felt that they were playing way too close to the sun in that respect. Of everyone that has troubles with Hasbro, it boils down into two categories: People who try to make money from Pony IP, or people who try to present themselves as professionals and part of a company. There is a lot of space under the radar, provided you don't try and stand too tall.

Sorry, sensitive subject.

Treating the subject seriously for a moment, there are nineteen stallions among the main and supporting cast, including designated antagonists. Of those, four are colts and one is a baby, which preclude their being both attractive and non-creepy. Carrot Cake, Filthy Rich, and Shining Armor are married (Filthy Rich and Diamond Tiara's mother may have split up, as we've never seen her onscreen, but there's no reason to suppose this is the case), and both Fancypants and Jet Set are in relationships (ymmv), which means they were attractive to somepony at some time in some way. The single stallions include: Big McIntosh, Braeburn, Flam, Flim, Hoity Toity, Joe, Prince Blueblood, and Thunderlane, of which three so far have been called out as being attractive to somebody. I suppose King Sombra should be mentioned somewhere, though as he's dead (ymmv) there isn't much point in discussing whether he's attractive or not.

Final Thoughts
Well, that was a nice episode. While it's a shame it wasn't the surprise Rarity episode I was hoping it would be, I can't really think of any complaints I have with the episode, besides Pinkie being a bit too over the top.

Games Ponies Play, First Thoughts and Notes
Seemed like a nice episode. I think I liked it, but of course, as usual I'll save my final verdict until I've watched it again, without lag and stupid ads (seriously, how many times must I watch the same ad?)

Dash splattering on the spa roof and sliding off was by far my favorite part. Hilarious! Second place was Shining's face when the country pony was talking about meeting a prince.

Nice detail that when the Crystal Ponies cheered at the end, their joy powered up the Crystal Heart there. I like little consistencies such as that.

Not a bad episode overall. Jives well alongside Just for Sidekicks (which was more fun in my opinion).

New Episode:
I just noticed how when the games were announced to be in the Crystal Empire, the crystal heart responded and did it's 'spread happiness' thing. That would indicate that the rest of equestria HAS to keep the crystal empire happy, no matter what. Every time the crystal empire is disappointed, the emotion spreads all across equestria, making everyone just a little less cheery. They essentially hold the general happiness of the entire country in their hooves. They don't even have control over it, really, since the heart seems to respond without prompting. If the crystal empire is hungry, the rest of equestria needs to give them food or the entire land suffers. What if the crystal empire is so rich just because the rest of the world knows you need to keep them happy or suffer the consequences?

Final Thoughts

Fancy Pants' design is pretty cool too.

You should absolutely play Pheonix Wright. The games play out pretty much exactly the way that Turnabout Storm does. And it's great.

I stand by my assertion that most stallions, especially those with the more ... buff body types, are not at all handsome or cute. Shining Armor and Prince Blueblood just look kinda grotesque, really. Not as grotesque as Horse Power, of course, but still.

I actually like Thunderlane a lot, much more than I have any legitimate reason to. Though it might be because I named one of my X-COM soldiers after him and he turned out to be completely awesome.

1. I dunno if they have to keep them THAT happy. I think they can get by on just not enslaving the poor ponies under an iron hoof. Now, if instead keeping the empire happy means the rest of Equestria is getting it's "Happy Fix", then we have a different kind of issue. :smallwink:

2. If you want the complete frown, they also skipped AJ's mention of her "Dogs Barkin'".

3. Wife Javelin Toss would be fun.

4. I'd assume someone in the royal guard gets the promotion so that Celestia doesn't have to pay Shining for travel expenses.

I'm guessing the "good" lich's issue is with the inclusion of humans, not the pokemon themselves.

Because Applejack worked at a cherry orchard in one episode. Part of making Original the Characters is being as far away from the source as possible.

Another false rumor that would be really easy to start rolling around the entire internet is that the reason why the C&D happened now is that Hasbro might have secretly recently signed a contract with an official video game company and is actually producing some sort of official competitive pony video game. I think the most remarkable thing I learned from that process is that Hasbro doesn't have a department that goes around taking things offline. Instead you've got what is basically a call centre full of dudes who watch videos all day, every day, and these are just average schmoes without much legal understanding. They flag stuff and it automatically enters Youtube's system. Lawyers and cackling corporations are not actually involved at any point.
The thing that's funny to me, is that, ignoring Hasbro for a moment, YouTube's copyright reporting system errs on the copyright holder. I had to contest a violation claimed by Disney on one of my videos a few days ago. It's a delicious contrast between this situation and the situation prior involving the documentary.

And for some reason that image reminded me how not a single stallion in the show is handsome or cute.

just woulda had to add the 3 seconds of AJ sitting down and hearing winona to make full use of that bit

but we heard the question that led to her line about "if he is keeping his head"(or whatever it was)
in sidekicks there is no sigh before the answer..in this one we have the sigh

so even if they didnt show it in sidekicks we should have heard the sigh..and in sidekicks they showed her bringing her hoof up from the ground at that point..not pushing it out from chest

otherwise they stayed pretty consistent

Okay, first off, Twilght, you are forgiven for last episode, since this clearly was, as we had speculated, the setting up, rather than the actual games, and thus leaving Spike was reasonably justified.

Also, framing this episode with last episode was clever.

Sadly, the old mistaken identity plot was a bit tired, even when fairly well exectuted as here. It was way too obvious from the get-go (I even paused to check that it wasn't Colgate that was the inspector when that one first showed up), and I found that rather detracted from everything, as I simply found I was waiting for the other shoe to drop.

Cadance's hair subplot was more engaging.

Nice to see Shiny and Cadance again (and seeing Shiny doing his best drill sergeant impression. Guess coaching is not a bad substitute for being in charge of the guards - as we didn't seem to see any (maybe they don't have any in the Crystal Empire?)

Rarity stole the show here, but Cadance gets a solid second for reminding Twilight how to keep calm. Also Pinkie.

Not a bad episode, but more for the interaction of the characters than the plot.

Oh yes, Rainbow had parents. Dammit, I guess Winning Pony is now officially AU, since I'm pretty sure that was a male she was perched on. (Well, I suppose one could rationalise older brother...)

Now back to see what everyone else thought.

Today's episodeThat was an uncomfortable 10 minutes to watch, just waiting for the lady to say she wasn't the inspector. Also, the Crystal Empire should be the host every time so the ponies can power the crystal heart and spread the happiness over Equestria. :smallbiggrin:

Because we see them in a later episode. Today's episode further proves that, since it works directly with another. And the season finale will make that even more apparent.

Star Trek in general is fairly similar in that regard, and I think it's what they're shooting for: you can watch most episodes out of order and not get too confused, but watching them in order gives them a little extra context. Go ahead, watch episodes of TNG or Voyager at random to see what I mean.

So, new episode.

It was nice. Honestly, I prefered last week's, but rainbow crashing into the spa's roof was pretty hilarious. Otherwise I felt it was a bit bland, though never really boring. I liked the little continuity things. Also, Shining Armor's hat looked really silly.

That said, the previews for the season finale we got to see during the commercial breaks were pretty interesting. I hope they don't try to press too much stuff into it this time, though. Things felt rushed enough when they had two episodes to work with.

She's claustrophobic. And I would say an extreme case, because those rooms inside the castle are HUGE. But seeing the ceiling spinning, needing to "stretch her legs", it seems like a definite case.

Definitely the exception, limited to what Luna Eclipsed, Magic Duel, and KCaFO really. Sure other times seeing other episodes helps, but it isn't demanded you know.

And trying to make a coherent timeline is highly interpretative. From midsummer to winter, to fall, yet Spike celebrates his first birthday in Ponyville in season 2. And that's not counting fun details like the Gala dresses visible before Suited for Success, and how long was the gala in coming anyways. I think any attempts to order things are inherently flawed and wonky, demanding season mixing among other things.

That said there's some clear spiritual continuity as the writing has evolved.

I really enjoyed this, and thought Rainbow came off really well. Will probably rewatch it later, and recommend to siblings as a Good Episode.

That was a very very nice comic, hope the actual subject matter isn't the real reason, but if it is, that's a good way to overcome it.

I really liked this one. Not huge laugh out loud moments, but lots of little fun bits.

I really like that pony with the pale yellow coat and light green mane; I just can't put my hoof on why. :smallwink:

New Episode
Okay, well, mark this down as another one of those episodes that would have been horrible if anyone else had done it, but the show staff pulled it off. The payoff wasn't quite as big as some of the better episodes, but after that 10 minutes of painful mistaken identity, it worked out and actually paid off for everypony. Hurray!

Sweet and Elite is still my favorite episode for actually pulling off the web of lies plot in a way that didn't lead to a giant collapse and a painful Aesop. This one pulled off the stupid mistaken identity plot in a way that worked out well, though I found it overall less engaging than Sweet and Elite (perhaps the lack of song or that Rainbow, as focus pony, didn't get as much character growth as Rarity did in Sweet and Elite).

I was also quite happy with Twilight managing to keep calm and not freak out. It's a great demo of her character growth up to this point and even makes me think that she's becoming mature and ready enough for the insanity that will be the next episode.

I'm assuming that pony in the beginning was Dash's father. I'm also a little weirded out that the mane 6 didn't leave earlier to get to the crystal empire. Even with the inspector's train being changed, why only leave yourself a few hours instead of being there a day in advance for something so important?

You know, it's kinda weird to hear you say Apple has ironclad case patenting rectangles and photoshopping competing products in court, then be sad when company that really stands something to lose has to send C&D letter, or risk being sued / losing their flagship product.

To me, first is still a travesty of patenting product, the second merely a sad consequence of dead end US legal system created. It's pretty much the same cause as why some companies that don't want to put DRM into their games - because US legal system forces them to or stand trial, so they err on the side of caution.

Different contexts. I agree with you that the world would be a better place if Apple couldn't patent a rectangle, but my analysis of what the law actually is comes out that their patent is reasonable, though hopefully too flimsy to litigate.

Here, my analysis of what the law is comes out that Hasbro probably has every right to shut down mane 6. However, I think it sucks and I wish they would negotiate around that because if private parties make an agreement, the law can be handled to respect that agreement in the vast majority of cases.

That assumes Kickstarter won't instantly shut down the whole thing once Hasbro sends them C&D letter, too. Plus, even is they won't, at this point it will be selling infringed product and Hasbro can demand, say, twice the project's profit (that is, twice the sum they raised) in court as punitive damage, IIRC.

There are no punitive damages in United States copyright. There are profits-based damages, but if Mane 6 raised $150,000 the profits damages would be equal to or less than that amount. Since they weren't planning on making money off their game, I really don't see any way that a lawsuit would be worth more than $150,000. Especially because the $150,000 is the max statutory damages for one instance of willful infringement, meaning you knew when you did it that it was wrong.

The crazy insane cases that made it into the news for millions were there because people sued under the theory that every song someone downloaded or uploaded on Bittorrent was a separate infringement, meaning they took $150,000 and multiplied by hundreds or thousands of songs. But Mane 6 have violated copyright one time, making one product.

Anyway, even if they couldn't use Kickstarter, they could just accept donations and pay taxes on the donations (since they're not a charitable organization). You can't stop people from freely giving money to other people unless they're doing something else illegal like buying drugs.

Really bummed about the Fighting is Magic deal. I wasn't going to play it, but it was an awesome idea and the fact that Hasbro was sorta seeming to turn a blind eye to it gave me hope. Oh well. At least they can't touch the sound track. Uh... Right? Please tell me they can't take away my Rarity's Theme. Please?

There's a case called Cablevision that addresses that. It related to on-demand television and it ruled that when you stick something on a server and each individual accesses it at their own time and place of their choice, that's on the individual, not on the guy sticking it on a server.

Edit: That is a super abbreviated summary, by the way. I'm going to edit again with the more nuanced version.

So, the case referred specifically to whether someone was making a public performance (i.e. broadcast) of the TV shows, and the answer was no, sticking them on the server for individuals to access on their own whenever was not a public performance. That said, each individual that was taking a copyrighted work was violating copyright, it's just that nobody wanted to track or sue these individuals because they were the TV customers and suing your customers is bad business.

Putting this in the mane 6 context, you have to think about what their actual violation of copyright is. They didn't literally copy anything Hasbro owns (they built their own art assets, even though they look like Hasbro ponies). What they've done is copy the Hasbro characters in a single game that infringes Hasbro's copyright in My Little Pony. So, the actual game is one thing and they haven't even made it available for download yet, so I only see one instance of infringement.

The download's aren't a separate thing because it's still the same infringing product. Making it available for download doesn't qualify as a public performance in my opinion and there's tons of precedent that stuff like people writing a song that is a copy of somebody else's song is a single copyright violation. Even in the Joel Tannenbam case (the guy that got sued for millions by the RIAA) they didn't make each download of the song a separate violation, only each individual song, of which he had over 30 iirc. If they had charged him for each download somebody had pulled off his system, the lawsuit would have been in the billions.

Oh, heh, there is a way to get it above $150,000, which occurred to me while I was writing the longer analysis. If instead of it being a violation of MLP's copyright, they instead did it as a violation of each of the separate character copyrights, they could get $1,005,000 ($150,000 per character, counting Angel Bunny). I'm not sure if that would actually fly though, I think a court would probably say that it's just copying My Little Pony and Hasbro splitting it up is an unfair cash grab.

It lets you try again. The games specifically divide up into sections so that if you fail utterly, you get to restart at that part of the trial (usually that witness or maybe one witness back). They're pretty tense at times, which is half the fun. The other half is actually shouting "Objection!" since it allows you to use your voice for that if you want.

For whatever it's worth, the main three games are on WiiWare, and my understanding is that an iPhone port of those games is pending.

The original game is out on iPhone already, just search it in the store.

In the meantime, have some Phoenix Wright ponies.

Ah. Well, I'll file that away for next time. I don't think it's too toxic for me to be derping with terminology, and I'm pretty burned out on this already. Thanks for helping to educate me. It's possible and I really hope something can be worked out that allows the project to continue. But it's highly unlikely, as the game has zero appeal outside of the secondary demographic. Hasbro has given bronies a lot of targeted toys, but they do it knowing that the kids will grab up just as many Steven Magnets as we will. The gains with regards to their focus with the franchise are smaller than will likely interest them.

But, you never know. Either way, I hope that people call off the war. It won't help.

Read the news about the C&D. Really, REALLY pissed off about it.

I've sort of come to the realization that my idea that Hasbro was interested in being a partner with this fandom was, from the start, painfully naive. Hasbro doesn't want to foster the brony community, Hasbro wants to control the brony community. Huge difference.

Hasbro is not our friend. Hasbro is our enemy, to be manipulated and circumvented by any means necessary. I bought season three via iTunes. I don't plan to buy season four, but you can bet that I'll be watching it.

Yeah I'm pretty upset about it too. It certainly makes me think the MLP FiM exists in spite of Hasbro not because of it.

First, it's kinda hard to gather team to do such a project if you do it in secret, second, you can't build recognition for what you're doing, third, you can still be hit with C&D once you publish it, and getting to that stage means the reaction might be even more drastic.

That assumes Kickstarter won't instantly shut down the whole thing once Hasbro sends them C&D letter, too. Plus, even is they won't, at this point it will be selling infringed product and Hasbro can demand, say, twice the project's profit (that is, twice the sum they raised) in court as punitive damage, IIRC.

First and third points: It's not completely secret, just not showing most of your work online. It'd be harder sure, but a better chance to get things done. As for the third point well once the game is out online could they really stop it? They personally might have to stop distributing it, but everyone else could share it freely.

I wish I quoted this but I can't see those crossovers you are talking about AotRS. Same think happened with Painted Jack. On the general subject of humanity needing to under your direct control, well I'll just say that idiots are in every single group and community in the world and that all humans are idiots sometimes about somethings.

Now my first impressions about the new episode!
Good nice episode. Loved the tie in with Just for Sidekicks. The humor was top notch too. Except for Pinkie. She was just annoying, except for the cinnamon bun part. Really this episode needed more Applejack.

Best jokes had to be the Crystal Pony window cleaner in the background. Followed by Rainbow Dash smashing into the spa window. Classic.

Small criticism in that I don't think Harsh Whinny's (best name) logic at the end made sense. Or her statement. That random pony (who I dub Chicken Little) was very biased, after all she just got the star treatment. It would have been better if Harsh Whinny had a good time despite being abandoned.

Random thoughts

Couldn't help but think that Cadance was training Twilight to be a Princess. Also hearing that Shining Armor is now a Prince is great.

On the Finale
Twilight's already technically part of the Royal Family. So perhaps it's more of a female thing and family thing. (only female Alicorns?)

Is it just me or has Rainbow Dash and Fluttershy been really touchy this season? Well Rainbow > Fluttershy at least. I swear someone on the staff ships Flutterdash (And I support that fully :smallbiggrin:)

You should absolutely play Pheonix Wright. The games play out pretty much exactly the way that Turnabout Storm does. And it's great.

So Shining Armor seems to be doing the full time Prince deal now. With a side of training the Crystal Empire athletes. I guess this means some other lucky pony got promoted to Captain of the Royal Guard? I can't imagine that he's keeping that job while living halfway across the country.

Obviously, the job went to Twilight's other brother, who we haven't seen at all but is still there.

I am old enough to remember how much of my childhood Hasbro has aquired and destroyed. (Ok, fine, destroyed is too harsh, altered beyond recognition. )

Edit: ok that came out of a place of harshness. Fact is the part of my childhood that Hasbro now have the rights to are essentially ideas by other companies when I was still a kid. And most of them are basically unchanged. But I'm disinclined to attribute them the credit when they simply bought the rights. Given that, Hasbro is maybe only 10% of my childhood.

...You know, I don't think Hasbro got any of my childhood. What little TV I watched was mostly Sesame Street, Bill Nye, and Mister Rogers; my knowledge of Transformers consisted of "this friend has some toys with that name"; I didn't get into D&D at all until I was about sixteen...

Orrrr maybe I'm underestimating; looking at Wikipedia, Sesame Street is theirs, along with Parker Brothers (Monopoly and Risk were big in my childhood), Play-Doh, and Lincoln Logs. So maybe they're more present than I thought.

Certainly that's true. My problem with Michael Bay is Michael Bay himself though. His film just seem to have less substance and more explosion as time goes on. The Rock was the only film of his that I enjoyed. And that might be due more to the inherent hilarity of Nicolas Cage and Sean Connery than anything Bay contributed.

Back to pony and childhood. I think Disney and Mattel holds a larger portion of my childhood. Along with DiC entertainment, of which apparently DHX is the successor. (That and Japanese animation studio, anime holds at least 40% of my childhood)

And lastly back to pony. There is a point I reach, with any shows, where I decide it becomes too altered from what originally made it special. This is usually the point I stop watching. It happened around season 5 of The West Wing, for example. Now, I'm not saying pony has reached such point for me, but we shall see.

Ultimately all story should have an ending.

I don't have an iPhone myself (and I stopped following the series after Miles Edgeworth Investigations), I just hopped on GameFAQs to confirm that the trilogy was on WiiWare, and saw that there was a listing for "Phoenix Wright: Ace Attorney Trilogy HD" on the iPhone with a TBA release date on my way there.

I was not aware of this,and now I am very seriously considering buying it. I also discovered that Ghost Trick is free for the iPhone (Or at least the first few chapters of it, it's not entirely clear).

If any of you ponies have an iPhone or iPad, you need to play Ghost Trick. You will not regret it, I promise.

Mixed results with photos this time (the lighting was less the issue that I didn't focus very well, but then again I took most of the photos after setting up, which took about two-and-a-half hours, by which time I wanted to actually get started as the punters had long since been let in, and the Humourous Pictures to follow at the end didn't come out as well as I'd like (though this time not totally unsalvageable!) Still, the most import photo, the shot of the whole game came out great, so there's that.

We actually had a record breaker - the first exchange of fire (from the Jalyrkieon heavy tanks against that Tesla Coil down in the swamp there) went on for the longest chain of reactions and casualties we've ever had in Manouvre Group. By the time we'd finished the reactions of the first fire action of the game, there were five destroyed targets (four Soviet, one Jalyrkieon) and a couple more pretty knackered, all spanning off one shot! We must have had (including misses and such!) a good dozen back-and-forth reactions in that one phase...

And one of the Soviet tanks managed the unusual feat of rolling snake eyes on two D20 and still hitting twice! (1 is not an automatic miss - base 4 to hit, -4 for a second and subsequent shot at the same target, +1 for having a reaction marker...!) We assumed the gunner must have sneezed as he pulled the trigger...

Orrrr maybe I'm underestimating; looking at Wikipedia, Sesame Street is theirs, along with Parker Brothers (Monopoly and Risk were big in my childhood), Play-Doh, and Lincoln Logs. So maybe they're more present than I thought.
Admittedly, I'm this far away from starting a Yahtzee thread in Finding Players (Recruitment) just to see what madness comes out of it.

I think there were about a dozen comments I got when I was writing Hard Reset about this game, so congratulations on being the final prod I needed to just go download it already. Looks like it's two free chapters and then for ten bucks you get the whole game. I guess that's not such a huge risk to take.

Quite interesting. Reminds me of some old fairy tales and fables I read when I was small. I'm not quite satisfied with all of the allegories it made, but on the whole I think it is pretty good at capturing the spirit of the situation.

Given the whole reality-is-not-unchangeable is pretty fundemental to my entire being, I would have sort of thought I'd have picked up on it... (At any rate the ponies in the story did not exactly try to negociate with the dragon, but that doesn't by itself preclude the possibility... Though I think the analogy would break down somewhat at the point the ponies all band together and appeal to the inner workings of the universe to fundementally alter the way dragons view their hordes or something...)

Hmm, since the dragon was responsible for the assembling of the hoard, killing it or moving it would probably have been the last thing they wanted to do. :smallconfused:

As for the vibe of the whole tale, I think you are right in that it presents the hoard and dragon as facts of the setting, but to me that's only because it is a recounting of what currently is, right now, as opposed to what could be.

On the matter of the future for those Hoardsmiths, the last paragraph, and the last line in particular, ends hopefully, so there's no real telling whether things might or might not change later on.

Then again, it's a story, so it's all open to interpretation. Like the inspiration for such a nice piece of writing, I have no idea where it came from.

I have to admit, I kind of agree with you on that. That was the one problem I had with the whole parable, since I felt it just wasn't perfectly comparable to the real situation and speaks about an unchangeable natural law instead of a man-made one. Then again, no metaphor can perfectly replicate the problems it speaks about, and I have no idea whether that was even part of the message of the story.

That said, I'm really tired at the moment, so perhaps I am just missing something utterly obvious.

At risk of stretching this metaphor well past it's breaking point, it may be true that
a) if there were no dragons, yet hoards would come into being from some other source or
