[3.5] Telflammar Shadowlord Death Attack Stacking at 1st?

Assuming a character already has a level of Assassin, do Telflammar Shadowlord levels start stacking for Death Attack at TSL level 6 (when it gains the Death Attack ability) or at TSL level 1?

Coincidentally, I had this very same thought today. I'd rule they begin stacking at TSL level 1. It doesn't make sense to think TSLs get no bonus to Death Attack DC until level 6, then suddenly get +6 to the save DC. If a character can already make a Death Attack, they should get progressively better with as they advance in TSL, not suddenly get all the benefits at the last level.
