I'm just curious on the legalities of this. I'm sure no one here is a legal expert, but I'd like to hear people's thoughts. Obviously you can do it (http://www.giantitp.com/Shop.html), so my first guess would be that as long as it's in the SRD, it's fair game to use as a basis for your work. I'm sure that Wizards of the Coast doesn't want you slapping a d&d logo on the front of it, but otherwise, I don't really see any big problems, as long as you're not trying to use their FR, Eberron, etc. settings.

Anyone know anything more about this?

Also, regarding the SRD: there's enough stuff in there that it might almost be easier to list the things that don't fall into it (i.e. mind flayers, beholders, the Greyhawk pantheon, the name of certain famous wizards on the spell list like Bigsby, Mordenkainen, Melf, etc.). Does anyone know of a list like that?

Asking for or giving legal advice is not permitted per the rules of this forum.

Perusing the OGL terms and conditions will probably answer your question.

The OGL's wording seems a little unclear sometimes.

Here's a link (https://www.wizards.com/default.asp?x=d20/oglfaq/20040123f) to the OGL FAQ.

To be more specific, I'll point you to Wizards' explicit mention of it.

Q: Is Open Game Content limited to just "the game mechanic"?

A: No. The definition of Open Game Content also provides for "any additional content clearly identified as Open Game Content." You can use the Open Game License for any kind of material you wish to distribute using the terms of the License, including fiction, artwork, maps, computer software, etc.

Wizards, however, rarely releases Open Content that is not just mechanics.
