It goes on to specifically note that those who fly with wings fall due to being unable to flap.

Being unable to move or act means you can't move with magical flight. However, as it's magical flight that doesn't use wings, you probably hover helplessly in place rather than falling.

To be more specific, it says the character cannot take physical actions, but can take purely mental ones. Wouldn't magically flying be considered a mental action, since it has no need for physical movement?

Note also that some flight effects require you to end your turn on a surface that can support you. Obviously, being paralyzed mid-flight would make this a bit problematic.

Honestly, it's a DM's call. "Purely mental" would belie "moving," but it's undeniable that "purely mental" actions would include casting stilled, silent spells and using psionic powers, and those can have definite motive force in the world.

Probably, yeah.

If you're jumping you're hosed, though, since you are now frozen in midair until the paralyses wears off.
RAW is weird sometimes.

A player character in my game once used some ingenuity to get out of a bad situation. She (the character) had been captured, tied up, and thrown into the back of an open wagon. She was able to work one hand free and, using spot, noticed a few bird feathers on side the road. She then used Prestidigitation to grab the feather and immediately cast Fly on herself and flew off to the amazement of her captors; still mostly trussed up.

Fortunately she was able to fly to the rest of her party before any pursuit could get there. She did however lose all of her belongings... Still, I thought it was creative thinking on part of the player.
