Does Vampiric Touch work on Undead/Constructs etc

Simple question! I cant see any kind of keywords like negative energy that would suggest it wouldn't but my DM disagree's.

No, this does not work on anything lacking a Constitution score.

I will work on some constructs, as warforged have the living construct type, and are living creatures.
