Hello,

I don't know if this has been asked before. How does OOTS manage its copyrights issues with Wizard of the Coast?

What I mean is: This comic is clearly based in the D&D rulebooks, using the classes, mechanics and spells that are in there. I believe that if you do a fan comic with no profit there would be no problem, but Rich is making money out of this.

Has he ever talked about this before? I am really curious to know how this is seen from a legal point of view.

It looks to me that any time he shouts out a rule-based name (like "Prismatic Spray") it comes from the SRD (http://www.d20srd.org/). The SRD is explicitly licensed under the OGL, and that's the reason it works, I believe.

Then there's the fact that he's lampshaded it most resoundingly (http://www.giantitp.com/comics/oots0065.html). (I suspect it falls under the "parody" clause of fair use.)
