Circle of Death (Sp): Once per day, when you issue the command word and make a circular gesture with the item, you cause it to kill living creatures within 40 feet, as the circle of death spell. The save DC is 19, or 16 + your Charisma modifier, whichever is higher.

Would this ability have the d4 targeting as well, or is it just everyone in 40 ft? If so, what would be the Caster Level?

Yes. The caster level for legacy item abilities depends what menu they come from or correspond to (if homebrewing)
Least:
5 for menu A abilities
7 for menu B
10 for menu C
Lesser:
10 for menu D
11 for menu E
13 for menu F
Greater
15 for menu G
17 for menu H
20 for menu I

Circle of death is from ability menu F, so CL 13
