Troubling Oblivion Glitch

This is the largest online community I belong to so im asking for help here. I have had problems with a very nasty (in my opinion) oblivion glitch. Whenever i pick up an empty grand soul gem it wont in my inventory, or perhaps appears as a filled gem. This isnt so bad, but it means i have no way of making Black Soul Gems. I have Oblivion for the 360 and im wondering if their is any sort of patch i can get off of xbox live that will fix my problem.

Well, if you have Xbox live, they download patches automatically when you log in and play that game. You don't need gold for that either, it just happens. I'm not having this trouble with my copy, but I have live constantly and have downloaded all the current patches.
