A 10th lvl eldrich knight, 10th lvl wizard, casts spells as 13 th lvl character.
Since he has 7th lvl slot and a spellbook, could he learn a 7th lvl spell to add to his book?

According to the rules, yes he can. As well as use any item that casts a 7th level spell without having to make the activation check.

EDIT----

I am Error

But sorcerer or cleric for example, wouldn't know any 7th lvl spells yet. Right?

No they wouldn't, but they can use the 7th slot to cast a powerful version of a spell they do know.

The wizard cannot add 7th level spells to their book. They can still only add spells to their books that their Wizard levels allow them to know (5th level). It's pretty much plainly stated and impossible to misread. Even if you do allow them to add 7th level spells to the book, they can't use them.

You determine what spells you know and can prepare for each class individually, as if you were a single-classed member of that class. If you are a ranger 4/wizard 3, for example, you know three 1st-level ranger spells based on your ranger class. As a 3rd-level wizard, you know three wizard cantrips, and your spellbook contains ten wizard spells, two of which (the two you gained when you reached 3rd level as a wizard) can be 2nd-level spells.

If you're multi-classed, you cannot know spells in one of your classes of higher level than your levels in that class alone would allow. Period.

He cannot learn a 7th level spell, or more accurately, despite having 7th level slots, he does not have the wizard level to prepair a 7th level spell. Under the multiclassing rules on page 164 in the PHB, it states that:

You determine what spells you know and can cast for each class individually, as if you were a single classed member of that class.

Since you determine your wizard "caster level" (to put it in 3.5 terms) by your wizard level alone and your wizard class level is only 10, you can only prepair 5th level spells off of your wizard list. If you want to, you can cast them from a higher (7th level) slot, but in this edition, you do not gain access to a spell level by gaining access to a spell slot.

Hope that clears it up.

Actually, you could add the spell to your spellbook, you just can't ever prepare it.

The details for adding spells to your spellbook just says you need to have the right spell slots, not that they have to be ones you could cast/prepare. The rules for multiclassing say you prepare spells as if you were single classed, but never touches on spellbooks.

I guess this could be useful for adding spells to your book to let other wizards copy from down the road.
