To all that said you can auto counterspell an upcast counterspell here is the RAW that states otherwise, so start rolling your counterspell against upcast spells all.

"When a spell caster casts a spell using a slot that is of a higher level than the spell, the spell assumes the higher level for that casting. For instance, if Umara casts magic missile using one of her 2nd-level slots, that magic missile is 2nd level."

so you just upcast the counter-counterspell. what's your point? it can still be automatically countered.

Who are all these people who said that? Did people say a 3rd level counterspell would automatically dispel everything?
