Hellow fellow scibes....

Assuming you have just tripped your opponent, and he/she tries to stand up, triggering an AoO, you then hit, and with scorpion's grasp grapple the target. Where/how are you positioned now? Could it be, that you had picked up the target, or do you throw yourself on top of the target - to achieve the grapple position?

Well,
1) You have done nothing that says you go prone, so either you are grappling them while they are prone(but you are on a knee or something else non prone) or you are grappling them while neither of you are prone.

2) You have done nothing that says they fail to stand up, so they are probably standing up.

3) Your AoO precedes the action that triggered it.

Conclusion: As they started to rise you dropped to one knee to start grappling them, exploiting their efforts to rise to establish a grip. By the time they have finished standing up you are locked in a grapple.
