Can a bard Dance to get there spells and special ablilitys?

No, they can not by RAW. But your DM might allow it if you ask him.

According to the SRD:


Once per day per bard level, a bard can use his song or poetics to produce magical effects on those around him (usually including himself, if desired). While these abilities fall under the category of bardic music and the descriptions discuss singing or playing instruments, they can all be activated by reciting poetry, chanting, singing lyrical songs, singing melodies, whistling, playing an instrument, or playing an instrument in combination with some spoken performance.

By this definition, no. Unless...his shoes had metal heels and he had Perform (tap) as tap-dancing can be quite rythmic...

I can't help but think that there may be a way to take the word 'poetics' into meaning something the RAW really didn't mean but is technically correct.

Like performance art. Buff your party, baffle enemies.

"Why is their bard using the spoon like a hat?!"

Don't worry, Mr De-Trick. The Bardic music description allows for all sorts of good musical choices...rap, beatbox, a capella, singing accompanied with coconuts, etc.

It's a game balance issue. if he allowed you to do your bard effects through dance all of the time, then you would be effectively uneffected by silence effects. Essentially the bard effects have a somantic component.

Bard: Must dance to help
warrior 1 : he dances so good im inspired
warrior 2 : IM pumped from that spin

Seriously though, it doesn't affect game balance much considering you don't find yourself in zones of magical silence all that often; in effect, rather than forbidding silent spell for a bard, you're forbidding still spell for a bard. That said I probably wouldn't allow something like this because frankly it sounds pretty silly.

That may be, but it is far easier than to escape something that silences you than something that stops you from moving. Seriously, if you can't move, than you have bigger problems to worry about than not being able to cast spells.

I think a loose interpretation would allow a tap dancer or a clogger, but not much else. You could always dance and play music at the same time. Maybe a tambourine.
