And then a stray Dispel Magic hit it.

EDIT: You could also argue that you can't cast Awaken Construct on a PaOed Animated Object, as even though it would have a Permanent duration in this case the effect is only temporary.

Unless Awaken Construct specifically only works on humanoid shaped constructs. Can't Awaken an animate snake without your DM houseruling a change in.

Now, as to your second question, what if you animated and awakened a statue made from a petrified creature? I don't see how that would be any different from one that never had a living creature as source material. Let's say Awaken Construct didn't have the bit about only working on humanoid shaped constructs. An Awakened snake, turned into stone, the stone animated as a construct, awakening that is the same as any other stone. Going off of this, you could Animate Object a corpse into a temporary construct that looks like a zombie. It could fool people, but mechanically would be the same as any other Animated Object.

So we have a Gold Snake statue that is Colossal size.
We have a Wizard/Cleric (gestalt) of lvl21 cast Polymorph any object on it.
The polymorph any object turns it into a Animated object version of itself.



Same Kingdom (+5 mineral)
Same Size (+2 Colossal)
Same class (+2 metal)
Related (+2 both are still statues just one is moving)
Same Intellegence (+2 for know)



So It is Permanently changed into a Animated Object (13 score is above 9)
Later The Wizard/Cleric Cast Awaken Construct Dmm Intensified
We have a Construct that cost 5,000xp to make.

Until dispelled, yes. Then you've wasted 5k xp.

Also of note:
1) Polymorph Any Object may inherit the HD limit from Polymorph, as that is not explicitly overridden - in which case, you're limited to Huge animated objects (Gargantuan is 16 HD).
2) As noted by others, you've likely got an invalid target, on two counts: "This spell awakens a humanoid-shaped construct to humanlike sentience." - a giant snake isn't humanoid shaped, and "The spell does not work on constructs that are only constructs temporarily (such as objects affected by an animate objects spell)." - Polymorph Any Object may count as temporary.
3) Awaken Construct explicitly breaks any control you might have over the critter. Something smarter and wiser than you are may not choose to do what you ask it.

Nah, you've solved the shape problem by going humanoid shaped instead of snake shaped, but still you have the issue where you can't Awaken a temporary enchantment, such as PAO. The real solution is to bite the bullet and actually use the Craft Construct feat to make your buddy.

AFB so I can't check each individual check description, but you'd still be vulnerable to:
Slashing Dispel (PH2)
Reaving Dispel (Spell Compendium)
Chain Dispel (PH2)
Dispelling Breath (Spell Compendium)
Dispelling Screen (Spell Compendium)
Dispelling Screen, Greater (Spell Compendium)

As well as the area version of both Dispel Magic and Dispel Magic, Greater.

You only need +9 Duration Factor to make Polymorph Any Object permanent. It's already Mineral, Colossal, and Mindless. That's all you need in that respect. That doesn't get around the other problems:
1) The HD limit of polymorph (which PaO may inherit)
2) The little issue that it's probably considered a temporary construct by Awaken Construct.
3) That you don't have any control over the beast.

The spell blades would stop those specific spells. There's a lot of ways to dispel something in D&D.

PAO isn't temporary, in this case, though.

It's permanent, but "permanent" spells only lasts until dispelled.

Yup, this is why Awaken Undead is the worst of the Awaken spells. It has a duration of "permanent" which really means it's the only Awaken spell that isn't permanent.
