Let's say no one is attuned to a weapon of legacy. Does that weapon of legacy give off a magic aura? Can detect magic pick up anything?

I guess detect magic doesn't acknowledge an aura until someone activates the least legacy, at the very least.

Initially, it [a legacy item] might seem like nothing more than a standard magic item.

If scanned using detect magic, the remnants of a destroyed legacy item have a faint aura of no particular school.
Short answer: Yes.
Long answer: Even if they're destroyed, yes.

Hmmm, I forget. Is the basic requirement masterwork or +1? AFB at the moment

The vast majority of legacy items will register on detect magic and the like as a minor magic item according to the non-legacy statistic entry in their description. A custom item may have a non-legacy entry as a simple masterwork item but the book calls this out as particularly rare, likewise for more powerful than normal non-legacy entries. This is all spelled out in WoL.
