Epic Level Spirit Shaman + Improved Spell Capacity

Since Spirit Shamans have to "prepare" their spontaneous metamagic'd spells, and Improved Spell Capacity doesn't actually give you "retrieved" 10th level spells per day, would this feat not allow Spirit Shamans to actually use the 10th level and higher slots to cast metamagic'd spells?

You gain a 10th level spell slot with the feat. You use it as one of your spell slots. Any specific mechanic your class has should see this slot as a standard slot you usually have, without the need to explicitly tell you. Thus, you can retrieve any 9th level spell or lower with metamagic.
