Assume your DM bans Bo9S but you want something like those classes/prestige classes. What 3.5 first party stuff could you use to make something that comes close?

What part of Bo9S do you wish to emulate? Duskblade, warlock, binder, bard, dragonfire adept and more all can do some things.

Melee dps disvorced from full attacking to get most bang for your buck? Duskblade. Utility and melee capable? Warlock. Consistint control and reliable damage, DFA. Etc.

Factotum has per-encounter abilities and as a bonus, some of the rules are even as confusing as Bo9S! Can definitely role-play at being a swordsage!

Psionic feats like the Psionic Weapon chain give you combat options that you can expend and recover. PrCs like Dragon Descendant and Master of Masks (and to a lesser extent incarnum) give you a stance system of sorts.

I feel like it should be possible to rig something fun and toolbox-y together with a bunch of divine and domain feats, if not necessarily powerful, but I've never actually tried. Maybe a paladin with the Holy Warrior ACF...

I recommend Hellreaver. It's a PRC but I think it fits. Fill out the first 5 levels with varient Fighters or Barbarians ect.

Honestly, you could probably do okay with some kind of Gish. You're not casting wraithstrike, you're employing the Grasping Phantom Technique. That's not a Persistent divine power, it's your Righteous Fury Stance. And so on and so forth for all the Gish-y spells that DMs do not ban, despite pretty much all being better than anything in ToB.

A Warlock or DFA gish type can use their "special manoeuvres" (i.e. invocations) all day.

A Binder/KotSS has 1/5 rounds abilities.
