I think they were introduced in Unearthed Arcana as a variant rule.

Unearthed Arcana, then Eberron Campaign Setting, though they are wildly different systems that basically only share a name and a basic concept (what if: an additional, highly limited resource to spend) and were pretty clearly designed independently of each other, to the point that you could almost run both simultaneously and separately.

There was a prototype of action points introduced in Complete Divine. They were called faith points and were a unifying mechanic for a group of feats, but a lot of concepts from them were carried over into action points.

Why am I not surprised that there is no clear answer to such a simple question in 3.5... ?

d20 modern was published first in nov of 2002
which is WOTC, but not dungeons and dragons specifically

unearthed arcana was published in apr of 2004
