You mean the Swashbuckler class feature? You have to be specific with this one, as there are at least two other things in D&D 3.5e with exactly the same name.

Yes, you get the bonus regardless of which stat you are using for attack rolls. The weapon has to be eligible for Weapon Finesse, but you don't have to be using Weapon Finesse.
