Can I create the Arkenhammer as a homebrew, without violating copyright (Underaged here)?

Certainly, as long as you only use it for yourself.
Actually publishing is where legal issues become sticky. Luckily for you, Rob and Jamie are actively encouraging derivative work and have released Erfworld under a Creative Commons liscense. You should check out the Fan-Content sticky in the Erfworld forum as well as PM Rob or Jamie about it. (Rob is using the screenname "pclips". Jamie uses "jami".)
