I tend to think of it as "The car has the right of way in most cases, but that said, the driver really has to make sure that (s)he does not hit the pedestrian".
There is also talk of chaning the law to give pedestrians the right of way which I consider a mistake - too easy for them to deliberately block traffic.

America is big, so any sweeping generalization is going to be wrong at least somewhere by default, but a general rule of thumb might best be described as "its the driver's job to pay attention, and the pedestrian's job to not run out in front of a moving car."

It's not really that were big, it's more that we're basically 50 states that occasionally act as one state. To simplify it past the point of usefulness.

Oh, totally. But especially up in the NE there's a lot of states in a tiny amount of land, while the West has very few states in emourmous amounts of land. It ain't the size that complicates things.
